2. Elizabeth THEUS was mentioned in the Annual Returns on the Estate of Jacob Fudge (dec.) on 1 MAY 1843 in Crawford County, Georgia.7 The returns read as follows:

Elizabeth Fudge as Guardian for Caroline Fudge made her return for 1842. Included were amounts paid to: John W. Ellis for tuition and books; Bond & Murdock; E.M. & E.M. Amos: James J Ray for shoes; herself $48 for one year board; and purchases of dresses and material. Also included was $60 received from hire of negro Charles and $45 for rent of land.

WILL - She signed a will on 20 FEB 1845 in Crawford County, Georgia.8 Elizabeth Theus Fudge's will reads as follows:

In the name of God, Amen. I, Elizabeth Fudge, of said county and state being of sound mind but feeble in body and knowing that I must shortly depart from this world deem it right and proper that I should make this my last will and testament, hereby revoking and annulling all others made by me.
Item First. I desire and direct that my body be buried in a decent and Christian like manner. My soul I trust shall return to rest with God who gave it as I hope for eternal salvation through the Blessed Lord and Savior Jesus Christ.
Item second. I desire and direct that all by just debts be paid as soon as commissioned by my executors herein after mentioned.
Item third. I give and bequeath to my daughter Ann Caronline Fudge and to her children (if she has any) free from the disposition of her husband (if she marries) my four negros, Andrew a man about fifty years old. Ann a woman seventeen years old, her child Solomon Scott ten months old and Tom a boy about fourteen years old also the following lands. Lot of land one hundred and seventy-two (172) containing two hundred two and one half (202.5) acres more or less, this being the lot on which I am now living. One hundred and fifty two and one half (152.5) acres of lot one hundred and eighty (180) lying, being and situated in the 7th district of originally Houston now Crawford County together with all the rights mention and apportioning any manner therewith belonging and I appoint my trusty and worthy friends John W. Ellis and Jonathan Ross trustees for my daughter and her children (if she has any).
Item 4th. The rest of my property both real and personal, wherin and whatever it my be, ___ so much as shall be herein after executed I wish to be sold, and the proceeds applied to the payment of my debts, and twenty dollars annually for the support of my mother, Sophia Theus, and the ____ to the maintenance and education of my daughter, Ann Caroline Fudge.
Item 5th. I loan unto my brother Henry Theus for the present year a bay mare named Sally and a sufficiency of provender for the keeping during the time and as much land as he may wish to cultivate, all to be returned at the expiration of the year.
Item 6th. I desire and direct that if my daughter Ann C. Fudge should die (without having a living child) for the whole of the property bequeathed above to be divided equally between my mother Sophis Theus, My sister Sarah McCarty (McGarty?) and my brothers Henry and John Theus.
Item 8th. I constitute and appoint my trusty friends John W. Ellis and Jonathan Ross, Executors of this my last will and testament this February 20, 1845. Signed Elizabeth Fudge

ESTATE RETURNS - She was mentioned in the Annual Returns on the Estate of Elizabeth Fudge (dec.) on 4 MAY 1846 in Crawford County, Georgia.9 She was mentioned in the Annual Returns on the Estate of Ephraim W. Dennis (dec.) on 6 JUL 1846 in Crawford County, Georgia.10 She was mentioned in the Annual Returns on the Estate of Elizabeth Fudge on 2 MAY 1847 in Crawford County, Georgia.11 She was mentioned in the Annual Returns on the Estate of Elizabeth Fudge (dec.) on 1 MAY 1848 in Crawford County, Georgia.12 She was mentioned in the Annuals Returns on the Estate of Elizabeth Fudge on 4 JUL 1849 in Crawford County, Georgia.13

MARRIAGE - Elizabeth Theus was married to Jacob D. FUDGE Jr. (son of Jacob FUDGE Sr. and Margaret) on 14 SEP 1830 in Crawford County, Georgia.14 Jacob D. FUDGE Jr. was born about 1758 in South Carolina.15,16 and died on 5 JAN 1842 in Crawford County, Georgia.34

OBITUARY - The abstract of the obituary is found on p. 72 of Marriages and Obituaries From the Macon Messenger 1818-1865 by William L. Rocker. 1988. Southern Historical Press, Inc. It reads as follows:

"Died in Crawford county on the 5th inst. Jacob Fudge, a native of Pennsylvania, aged 84 years. He was a revolutionary soldier."

The DAR Patriot Index: Centennial Edition Part I, p. 1099 lists his place of birth as South Carolina. This place of birth more closely matches other records.

PROPERTY - He was granted 640 acres of land on 5 JUN 1786 in Edgefield Co., SC.17 This land lay on both sides of Little Horse Creek of the Savannah River. He was selling land to Jacob Fudge, Sr. on 28 NOV 1787 in Edgefield Co., SC.18 This was the 640 acres of land originally granted to Jacob Fudge, Jr. on Jun 5, 1786, and lay on both sides of Little Horse Creek of the Savannah River. He was mentioned in a deed as owning adjacent land on 27 MAY 1794 in Edgefield Co., SC.19 He was mentioned in a deed as owning adjoining land on 14 SEP 1795 in Edgefield Co., SC.20 He was mentioned in a deed as owning adjoining land on 14 OCT 1795 in Edgefield Co., SC.21 He was purchaseing land on 28 AUG 1797 in Columbia County, GA.22 The abstract of the deed from Maddox and Carter reads as follows: s/Aug. 28th, 1797. R/Mar. 31st, 1798. Benjamin Finney and Anne, his wife, seel to Jacob Fudge, for $400, a tract of 245 acres on Uchee Cree, sold to Finney by Thomas Watson. He was selling land on 22 MAY 1798 in Columbia County, GA.23 The deed abstract from Maddox and Carter reads as follows: s/May 22, 1798. r/July 8, 1800. Jacob Fudge to John Tindall for $42, a 24-acres tract on Uchee Creek, originally granted to James Cobbs and Wm. Tindall. He was listed as having his land sold for the collection of taxes on 20 NOV 1802 in Columbia County, GA.24 On November 20, 1802, an article appeared in the Augusta Chronicle stating that land belonging to Jacob Fudge would be sold for collection of taxes for the year 1800. The land consisted of 221 acres in Columbia County, adjoining Tendill. He was listed in the Augusta Chronicle as having a letter in the post office on 17 JUL 1812 in Augusta, Richmond Co., Georgia.25 He was listed in the Augusta Chronicle as having a letter in the post office on 5 APR 1819 in Augusta, Richmond Co., Georgia.26 He appeared on the census in 1820 in Columbia County, GA.27 He appeared on the census in 1830 in Houston County, Georgia.28 He was buying land from Stephen D. Lewis on 28 JUN 1831 in Houston County, Georgia.29 This land transaction is the first for Jacob Fudge in Houston County, Georgia. It is recorded in Deed Book E, p. 113. He was selling land to David Fudge on 27 DEC 1834 in Houston County, Georgia.30 Jacob Fudge sold land to his son David Fudge (Lot No. 2, Dist 14) in Houston County, Georgia. This land transaction was witnessed by another son, Solomon Fudge. He was buying land from Elijah Johnson on 6 FEB 1838 in Houston County, Georgia.31 Jacob D. Fudge bought 202 1/2 acres (Lot 138, Dist 9) in Houston County, Georgia from Elijah Johnson for the price of $125.00. Jacob D. Fudge's county of residence according to the deed was Crawford County, Georgia. This deed was witnessed by Elijah H. Hicks, grandson-in-law of Jacob D. Fudge. He appeared on the census in 1840 in Crawford County, Georgia.32

WILL - He signed a will on 10 JAN 1840 in Crawford County, Georgia.33 Jacob Judge's will was signed on Jan 10, 1840; probated on Feb 24 1842, and returns made on Mar 22 1842. He died on 5 JAN 1842 in Crawford County, Georgia.34

He was listed in the Miscellaneous Estate Records in MAY 1842 in Crawford County, Georgia.35 The returns of May 1842 on the estate of Jacob Fudge (deceased) read as follows: John W. Ellis, Jonathan Ross, L. J. Gray and Samuel Dukes as Appraisers (sworn 12 Mar. 1842 by B. Lightfoot JP) returned an inventory and appraisement of the estate as shown to them by the Executrix. Included was 152 acres of land off Lot No. 180, 181 & 72 in 7th Dist formerly Houston now Crawford County valued at $1200, one gold lot No. 827, 4th Dist, 1st. Sec (county not stated) valued at $20. Negroes returned were Andrew at $550, Charles at $700, Ann at $500, Maria at $550 and Eleanor at $100. Notes included were against J.W. Ellis $58, A.G. Slappy $45, Uriah Slappy $126, John Thees (Theus) $22.76, G.W. Person $47.60 and Jonathan Ross $125. He was was listed in the Miscellaneous Estate Records on 1 MAY 1843 in Crawford County, Georgia.36 The returns read as follows: Elizabeth Fudge as Guardian for Caroline Fudge made her return for 1842. Included were amounts paid to: John W. Ellis for tuition and books; Bond & Murdock; E.M. & E.M. Amos: James J Ray for shoes; herself $48 for one year board; and purchases of dresses and material. Also included was $60 received from hire of negro Charles and $45 for rent of land.

MILITARY SERVICE - He served in the military in Revolutionary Soldier.37,38,39 Filed a claim for Revolutionary service in South Carolina.

Henry THEUS40 was born about 1801 in South Carolina.41 He was listed in the 1852 Tax List in 1852 in Taylor County, Georgia.42 Henry Theus was found in the 757th district of Taylor County, Georgia. He appeared on the census in 1860 in Taylor County, Georgia.43 Named in will of Elizabeth Theus Fudge.

She was Annual Returns on the Estate of Elizabeth Fudge on 2 MAY 1847 in Crawford County, Georgia.64 She was Annuals Returns on the Estate of Elizabeth Fudge on 1 MAY 1848 in Crawford County, Georgia.65 She died on 13 MAR 1916.66 Named as heir in will of Jacob Fudge and also Elizabeth Fudge.

She was married to William Tarver ROSS in MAR 1854.67 William Tarver ROSS was a Physician.

Ann Caroline FUDGE and William Tarver ROSS had the following children:

It was probated on May 6 1932. Named in her will are her unmarried children. They are: James Theus, Walter Theus, Eddie Theus, Amos Theus, Georgia Theus and Julia Theus. Executors of the will were R.P. McGuffin, J. P. Harmon and L. A. Harmon. She died on 9 APR 1932.86 She was buried after 9 APR 1932 in Bethel Cemetery, Taylor County, Georgia.87

He was married to Malinda PEED on 21 NOV 1882 in Taylor County, Georgia.145

 

12. Thomas B. THEUS was born on 7 AUG 1841.146,147 He appeared on the census in 1860 in Taylor County, Georgia.148 He served in the military between 1862 and 1865 in Confederate States of America.149,150 Thomas B. Theus enlisted into Co. C of the 59th Infantry on May 8, 1862. He was captured near Appomattox, Virginia on April 6, 1865. He was paroled at Burkeville, Virginia between April 14-17, 1865. According to family legend, Thomas B. Theus walked home from Burkeville, Virginia to Taylor County, Georgia. He appeared on the census in 1880 in Taylor County, Georgia.151 He appeared on the census in 1900 in Taylor County, Georgia.152 He died on 3 MAY 1918 in Taylor County, Georgia.153 He was buried after 3 MAY 1918 in Bethlehem Cemetery, Taylor County, Georgia.154

He was married to Susan Emma GRESHAM (daughter of George W.
